Participation
Participation from 18 years of age. Employees of STYA GmbH and affiliated companies are excluded. 

Submission & Rights
By submitting photos/videos, the participant confirms to be the sole rights holder and to have obtained the consent of all recognizable persons (model release); no images of minors.
The publication of selected submissions is part of the contest; by participating, the participant agrees to the publication for this purpose.
The participant grants STYA a simple, gratuitous, unlimited in time, space and content right of use for the content, including reproduction, distribution, public accessibility, editing (e.g. cropping, retouching, text/logo overlays) and sublicensing to platform operators. The use includes, among others, STYA websites, social media profiles, newsletters, print/POS, dealer & marketplace pages, Google Business Profile and advertising (incl. Google/Meta/TikTok ads). STYA may use the submissions for PR purposes. Distorting edits are excluded.
The participant indemnifies STYA against claims from third parties arising from any legal infringements.

The participant agrees that STYA may refrain from naming the author if a mention is not possible or unreasonable due to technical, legal or design reasons.

Prize, Determination, Notification
Prizes: The amount/voucher will be paid out/refunded via the payment method used for the order. Winners will be notified by email and must respond within 14 days; otherwise, the claim expires and will be re-awarded.

Liability
No liability for data loss during transmission, except in cases of intent or gross negligence.

Miscellaneous
Legal recourse regarding the determination of winners is excluded. German law applies. STYA reserves the right to moderate/exclude contributions that violate law or good morals.

2. Purposes & Legal Bases
a) Execution of the contest (acceptance/review of submissions, winner determination, notification, prize distribution) – Art. 6 (1) b GDPR.
b) The publication of selected submissions is part of the contest; by participating, the participant agrees to the publication of his/her submission if selected. Publication & promotional use of the submitted content on the mentioned channels as part of the contest – based on your consent – Art. 6 (1) a GDPR. By participating in the photo contest, you give this consent. Participation in the photo contest is voluntary; without participation, no publication.

3. Categories of Processed Data
Contact and communication data (e.g. name, email), submission content (photos/videos, captions, metadata such as date/location of capture), participation/prize information.

4. Recipients/Categories of Recipients
Internal departments (marketing, e-commerce, customer service), processors (hosting, email/DAM systems, agencies), platform operators (e.g. Meta, Google, TikTok) for publication/ads, payment service providers for prize payouts, shipping service providers for material prizes.

5. Third-Country Transfer
When publishing/advertising on platforms (e.g. USA), data may be transferred to third countries. This is done on the basis of appropriate safeguards (e.g. adequacy decision/EU-US Data Privacy Framework or EU Standard Contractual Clauses). Details can be found in the privacy policies of the respective platform operators.

6. Storage Period
Data for contest processing: up to 6 months after the end for evidentiary purposes; statutory retention obligations remain unaffected.
Published content: until revocation of your consent; already printed/published materials/archive posts remain unaffected.

7. Rights of Data Subjects
Right to information, rectification, erasure, restriction, data portability and revocation of given consent at any time with effect for the future (Art. 7 (3) GDPR) – e.g. by email to gewinnspiel@stya.de. Also, the right to lodge a complaint with a data protection supervisory authority.

8. Obligation to Provide / Consequences of Non-Provision
For participation, the data required under section 3 must be provided. Consent to publication is part of participation; without this consent, participation is not possible (participation is voluntary)

STYA reserves the right to terminate or modify the contest at any time without prior notice if proper execution cannot be guaranteed due to technical or legal reasons.
